Spectrlink Terms of Use

Developer: the developer shown as the seller on Spectrlink's App Store / Google Play page
("Spectrlink", "we", "us")
By installing or using Spectrlink you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
1. What Spectrlink is
Spectrlink is only a client app for the open Matrix protocol, like an email app is a client for mail servers. It is not a messaging service. We do not provide accounts, servers, storage or communication services, and we do not carry your messages, files or calls. You connect the app to a Matrix homeserver that you choose; your account, messages, files and calls are handled by that server and the services it uses, under its operator's rules and responsibility. We are not a party to your relationship with any server operator.
2. Your responsibilities
- You must be at least 13 years old, or the higher age of digital consent in your country, and legally able to accept these Terms; your server may set a higher age.
- You alone choose the server you connect to, and you are responsible for that choice.
- You are responsible for your account, your devices, your password, your recovery key and your backups. If they are lost, nobody, including us, can restore your encrypted messages.
- You are responsible for everything you send, share or do with the app, and for complying with the laws that apply to you, including laws on encryption, export controls and sanctions. Do not use the app where that is unlawful.
3. Acceptable use: zero tolerance for objectionable content and abuse
There is no tolerance on Spectrlink for objectionable content or abusive users. You must not use the app to:
- send or share content that is illegal, or that sexually exploits or endangers minors;
- harass, threaten, bully, stalk, or incite hatred or violence against any person or group;
- share non-consensual intimate images, graphic violence, or content that promotes self-harm, terrorism or crime;
- send spam, scams, phishing or malware, or run bulk or automated unsolicited messages;
- impersonate others, infringe others' rights or privacy, or dox people;
- attack, probe or overload any server, other users or our push gateway, or circumvent bans or security measures.
4. Reporting and blocking
- Report a message (long-press it → Report), a user (their profile → Report user) or a room. The report goes to the administrators of your server with a reference to the message and the reason you choose; moderation is up to them. In an end-to-end encrypted chat they cannot read the message itself, so choose "Other" and describe what happened.
- Block a user at any time (their profile → Block user; manage the list in Settings → Privacy → Blocked users). A blocked user's messages and invites are hidden from you.
- You can tell us about abuse of the app or of our push gateway at [email protected]. We may, at our sole discretion, stop serving push notifications to servers or devices that break these Terms. We do not host content and cannot remove it from any server.
- We have no obligation to monitor, review or moderate content or users, and we are not responsible for content created by users or for the actions of server operators.
5. Your content
You keep ownership of what you post and are solely responsible for it. We do not host it and claim no licence to it.
6. Third-party services
The app works with services we do not control: Matrix homeservers and the call, media and identity services they use, Apple and Google push services, app stores, and web pages that servers open for sign-in. Their availability, security, content and data practices are their responsibility and are governed by their terms. We are not responsible or liable for them.
7. Software licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use. You may not copy, modify, decompile (except where the law allows), resell or distribute it. Open-source components are licensed under their own terms, listed in Settings → About → Open-source licenses. On Apple devices Apple's standard Licensed Application End User License Agreement also applies.
8. No warranty
The app and our push gateway are provided "as is" and "as available", free of charge, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, security, non-infringement, and uninterrupted or error-free operation. In particular we do not guarantee that:
- messages, calls, files or notifications are delivered, delivered on time, or stored;
- the app works with any particular server, device or operating system version;
- encryption protects you against a compromised device, server or account, or against mistakes in verifying the people you talk to;
- data is never lost.
Spectrlink does not support emergency calls; do not rely on it for emergencies or for anything where failure could cause harm.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, messages, keys, profit, revenue, goodwill or business, arising from or related to the app, our push gateway, any server or third-party service, or content or conduct of any user, even if we were told such damage was possible. Our total liability for all claims is limited to USD 50.
Some laws do not allow these exclusions or limits; then they apply only as far as the law allows, and nothing here limits liability that cannot be limited by law.
10. Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless Spectrlink from claims, damages, losses and costs (including reasonable legal fees) arising from your use of the app, your content, the server you connect to, or your breach of these Terms or of the law.
11. Changes, suspension and discontinuation
We may change or stop the app or the push gateway, in whole or in part, at any time, without notice and without liability. We may change these Terms by posting a new version on this page; using the app after that means you accept it. You can stop using the app at any time. We may stop serving you if you break these Terms. Sections 2–6 and 8–12 survive termination.
12. Apple and general terms
- If you got the app from the App Store: these Terms are between you and Spectrlink, not Apple. Apple has no obligation to provide maintenance or support and is not responsible for the app or claims relating to it; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- We have no obligation to provide support, updates or maintenance, except where the law requires it.
- If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a part is not a waiver. You may not transfer your rights under these Terms; we may. These Terms and the Privacy Policy are the entire agreement between you and us about the app.
